How to Reclaim Overpaid Stamp Duty Land Tax From HMRC: Amendment, Overpayment Relief and the Evidence Required

How to Reclaim Overpaid Stamp Duty Land Tax From HMRC: Amendment, Overpayment Relief and the Evidence Required

How to reclaim overpaid stamp duty land tax depends on one date: how long ago the return was filed. Inside 12 months of the filing date the buyer can amend stamp duty land tax return entries and take a stamp duty land tax refund; after that, the only route is a claim for overpayment relief, which closes 4 years after the effective date of the transaction (GOV.UK "Apply for a refund of Stamp Duty Land Tax", published 26 June 2026). Once a purchase is past both windows, HMRC keeps the overpaid tax.

The two routes need different letters and different evidence, and HMRC says it may reject either as invalid if anything is missing. A buyer who has not yet confirmed that the return was wrong should start with Did Your Conveyancer Overpay Your Stamp Duty? How to Check. SDLT applies in England and Northern Ireland; Scotland and Wales charge their own land taxes.

When Can You Reclaim Overpaid Stamp Duty Land Tax

GOV.UK's refund guidance (published 26 June 2026) lists six situations in which a buyer may get SDLT back:

  • the higher rates were paid on a new main home, and the previous main home has since been sold;
  • the buyer paid the non-UK resident surcharge and has since become UK resident for SDLT purposes;
  • the buyer was eligible for a relief or exemption that was not claimed on the original return;
  • the residential rates were paid where the non-residential rates applied;
  • a mistake in calculating the tax on the original return led to an overpayment;
  • the right amount was calculated, but too much was paid to HMRC in error.

The fourth and fifth grounds turn on how the purchase was classified and calculated. Whether a building with a shop or offices counted as mixed use, and what the correct tax would have been, is covered in Can You Claim an SDLT Refund on a Mixed-Use Property? A purchase of several flats or houses in one deal has its own checks on the dwelling count and linked transactions, set out in SDLT on Buying Multiple Dwellings in One Transaction: What to Check.

The SDLT return and the tax are due within 14 days of completion (GOV.UK "Stamp Duty Land Tax", checked 26 October 2026). That deadline is also the start of the reclaim clock: HMRC's guidance on changing a return says "the filing date is 14 days after the effective date of your transaction", and the 12-month amendment window runs from that date (GOV.UK "Tell HMRC about changes to your Stamp Duty Land Tax return", published 26 June 2026).

How to Apply for a Stamp Duty Land Tax Refund

How to reclaim overpaid stamp duty land tax in practice depends on where the transaction sits in time, and a stamp duty land tax refund can be claimed online or by letter. The Finance Act 2003 sets out the two:

Route When it is open Legal basis How to claim
Amend the return Up to 12 months after the filing date FA 2003 Sch 10 para 6(3) Online, or by letter
Overpayment relief More than 12 months after the filing date, and no more than 4 years after the effective date FA 2003 Sch 10 paras 34 and 34B By letter

HMRC's manual confirms the 4-year limit for overpayment relief, running from the effective date of the transaction (SDLTM54000, checked 26 October 2026). The two routes do not overlap: overpayment relief is excluded where the buyer can correct the overpayment by other means, "such as by amending a transaction return" (SDLTM54120, checked 26 October 2026).

On a purchase that completed on 3 March 2026, the dates work out as follows:

  • effective date (completion): 3 March 2026
  • filing date, 14 days later: 17 March 2026
  • last day to amend the return: 17 March 2027
  • overpayment relief window: after 17 March 2027 until 3 March 2030

GOV.UK's refunds page links to an online checker that shows which route applies to a given claim.

Amend Stamp Duty Land Tax Return: The 12-Month Window

To amend stamp duty land tax return figures, the purchaser gives notice to HMRC, and "an amendment may not be made more than twelve months after the filing date" (Finance Act 2003 Sch 10 para 6(3), legislation.gov.uk, checked 26 October 2026). An amendment that produces a repayment must be accompanied by the contract for the transaction and the instrument by which it was effected, if there is one (Sch 10 para 6(2A)).

GOV.UK gives three examples of a refund made by amendment: changing the amount paid for the property, changing from the residential to the non-residential rates, and making a claim for a relief such as charities relief or group relief. A minor correction that does not produce a refund can be made by phone, but anything that leads to a repayment has to be made in writing or online (GOV.UK "Tell HMRC about changes to your Stamp Duty Land Tax return", published 26 June 2026).

The amendment route is also the only safe route for a relief that was left off the return. HMRC's manual says overpayment relief is not due where the tax is excessive because of a mistake "in making any other claim or election, or failing to do so" (SDLTM54110, checked 26 October 2026). A company that needs to amend stamp duty land tax return entries to add group relief or relief from the 17% rate should do it before the 12 months run out.

What Is Stamp Duty Land Tax Overpayment Relief and When Can You Claim It

What is stamp duty land tax overpayment relief? It is the statutory claim a person can make when they have paid tax that they believe was not due, under Finance Act 2003 Sch 10 para 34. HMRC's manual says it has been available since 1 April 2011, both to recover overpaid SDLT and to reduce an excessive assessment (SDLTM54000).

GOV.UK's refund page sets two conditions, and both must be met: it has been more than a year since the filing date of the return, and no more than 4 years since the effective date of the transaction. Paragraph 34B adds that the claim cannot be made by including it in a land transaction return, which is why it goes by letter. How the 4-year limit compares with the time limits on other taxes, rates and billing disputes is covered in How Far Back Can a Business Claim Money It Has Overpaid?

HMRC's manual lists seven cases, A to G, in which overpayment relief is not available (SDLTM54100, checked 26 October 2026). The two most likely to affect an investor are Case A, a mistake in making or failing to make a claim or election, and Case G, where the tax was calculated in line with the practice generally prevailing at the time.

Is There a Stamp Duty Land Tax Reclaim Form? The Letters and Evidence HMRC Expects

There is no stamp duty land tax reclaim form for a postal claim. Both routes are made by letter, and GOV.UK's refund guidance (published 26 June 2026) lists what each letter must contain.

Item Amendment letter (within 12 months) Overpayment relief letter (after 12 months)
Unique Transaction Reference Number (UTRN) Required Required
Full name of each buyer Required
Signatures of all buyers named on the return Required
Reason the buyer believes SDLT was overpaid Required Required
The parts of the SDLT return that are wrong Required Required
Revised figures and the refund due Required Required
Contract for the transaction, if there is one Required
Transfer instrument, such as a TR1 or lease Required
Supporting information and documents Required
Signed declaration from each buyer Required
Bank name, account number, sort code, account holder name Required Required

The declaration on an overpayment relief claim must confirm that the information given in the claim is correct "to the best of the claimant's information and belief". The UTRN is on the SDLT5 certificate where the return was filed online, or on the return and certificate where it was filed on paper (GOV.UK "Tell HMRC about changes to your Stamp Duty Land Tax return").

For the supporting documents, HMRC's compliance check guidance lists the records it expects a buyer to keep for each transaction: contracts, conveyances, maps and plans, payments, receipts and details of any financial arrangements, kept for at least 6 years from the effective date (GOV.UK "Stamp Duty Land Tax: HM Revenue and Customs compliance checks", last updated 14 December 2022). A claim that reclassifies a property needs the evidence for the new classification, such as the lease of a commercial unit or a plan showing its use.

Where to Send the Claim: The Stamp Duty Land Tax Address and What Happens Next

The stamp duty land tax address for both routes is BT Stamp Duty Land Tax, HM Revenue and Customs, BX9 1HD (GOV.UK, published 26 June 2026). The letter and the supporting evidence must go together. HMRC may contact the buyer by post if it needs more information (GOV.UK "Refunds of Stamp Duty Land Tax", checked 26 October 2026).

HMRC pays refunds to the purchasers. It will pay someone else, such as a solicitor or agent, only where the purchasers sign a letter confirming who should be repaid, and a solicitor or agent making the request must include a letter of authority from all the buyers on the return. GOV.UK warns that "a general form of authority may not be enough" for HMRC to process the refund.

How Long Does a Stamp Duty Land Tax Refund Take

For a buyer asking about a stamp duty land tax refund how long does it take, GOV.UK's answer is that HMRC "will usually make the payment directly into your bank account within 15 working days of receiving your claim" (GOV.UK "Refunds of Stamp Duty Land Tax", checked 26 October 2026).

HMRC can pay that quickly because it does not check the claim first. Its refund guidance says that "to process refunds quickly, we will make the payment without checking eligibility", and that even after payment "we have not agreed that the refund is due" (GOV.UK, published 26 June 2026). HMRC reserves the right to hold a payment for revenue protection reasons.

An amendment made while HMRC already has a compliance check open is not paid until the check is finished, and the closure notice says whether the amendment was taken into account (GOV.UK "Tell HMRC about changes to your Stamp Duty Land Tax return").

Penalties, Interest and Compliance Checks on Amended Returns

Stamp duty land tax penalties and interest apply to a refund that turns out to be wrong. HMRC has up to 9 months to make a compliance check on an amended return or an overpayment relief claim (GOV.UK, published 26 June 2026), and the Finance Act 2003 sets the same 9 months from the day the claim or amendment was made (Sch 11A para 7(1), legislation.gov.uk, checked 26 October 2026).

If a repayment was not due, the buyer must pay it back with any interest due, and any penalty on top. HMRC considers a penalty where an inaccuracy came from careless or deliberate behaviour, and it reduces the amount for a buyer who discloses the inaccuracy in full, helps to quantify it and cooperates with the check (GOV.UK "Stamp Duty Land Tax: HM Revenue and Customs compliance checks", last updated 14 December 2022).

Repayment interest can also be paid to the buyer. HMRC's interest rates page lists the SDLT repayment interest rate at 2.75% from 9 January 2026, set at the Bank of England base rate minus 1% with a floor of 0.5% (GOV.UK "HMRC interest rates for late and early payments", checked 26 October 2026). HMRC's compliance guidance says that where a check finds too much tax was paid, "in some cases you'll also get interest on the amount you overpaid".

A buyer who uses an agent keeps the risk: GOV.UK says the buyer is still responsible for checking that the claim is correct, and must repay the refund in full, with any interest or penalties, if the agent's claim is wrong (GOV.UK "Refunds of Stamp Duty Land Tax").

Reclaiming SDLT When a Company Bought the Property

The rules on stamp duty land tax for companies follow the same two routes. A company that bought a property is the purchaser on the return, so the amendment window, the 4-year overpayment relief limit, the letter contents and the BX9 1HD address all apply to it in the same way, and the refund is paid to the company unless it authorises payment to someone else in writing.

Where a conveyancer filed the return, the company remains responsible for checking any claim made in its name (GOV.UK "Refunds of Stamp Duty Land Tax"). A company buying residential property also completes an SDLT4 alongside the return, so a reclassification claim should check that form as well as the SDLT1 (GOV.UK SDLT1 guidance, updated 20 February 2026).

An SDLT refund is one of several property reliefs a company can pursue on a purchase. Land bought with contamination or dereliction can carry a separate corporation tax relief on the clean-up costs, set out in Land Remediation Relief: Claiming for Contaminated or Derelict Sites.

Relief Codes and Missed Reliefs on an Amended Return

Stamp duty land tax relief codes are entered at question 9 of the SDLT1 return. HMRC's guidance to the return (updated 20 February 2026) lists, among others, code 12 for group relief, code 14 for acquisition relief, code 35 for relief from the 17% rate and code 36 for relief for a Freeport tax site.

A company that left one of these reliefs off the return corrects it by amending the return with the right code inside the 12-month window, because SDLTM54110 excludes overpayment relief where the mistake was a failure to make a claim. The relief itself must still meet its own conditions, which HMRC's manual sets out page by page: SDLTM23010 for group relief and SDLTM09500 for relief from the 17% rate.

Conclusion and Next Steps: The Company Eligibility Check

The rules on how to reclaim overpaid stamp duty land tax put a fixed deadline on one form of unclaimed business tax relief, and the 12-month amendment window on the most recent purchase closes first. Run the company eligibility check to see which reliefs and refunds the company's property purchases may still support.
